Independent Fisherman

As an Independant Fisherman, you will earn a percentage of sales of fish you catch (and sells).

Our primary market area is within Palatka, FL to DeLand, FL including Ocala, FL. There is a minimum to maximum percentage (commission) Independent Fishermen will earn within this area. If you are outside this area, your potential earning percentage (commission) may be higher as you would (1) be allowing Red’s Fresh Fish to expand territory and (2) you will have more responsibility by default than those within our primary area. The remaining percentage due to Red’s Fresh Fish will cover the fees associated with operating under Red’s Fresh Fish. This is detailed in the ‘Terms & Conditions’ below.

At Red’s Fresh Fish sole discretion, we may offer Independant Fishermen full employment. Determining factors include, but are not limited to:

  • Devotion and loyalty to Red’s Fresh Fish
  • Amount of sales processed to pre-existing customers
  • Number of new customers obtained
  • Amount of time (measured in months and/or years) working with Red’s Fresh Fish as an independant contractor

Should the Independant Fisherman turn down the offer, the contract will remain until either party decides to terminate it.

Terms & Conditions

1. Status

Becoming an Independent Fisherman with Red’s Fresh Fish in no way signifies or establishes employment, an employment opportunity, etc. As an Independent Fisherman, you are an independent contractor and you are responsible for all your own taxes and business expenses.

You agree that you will not suggest or imply you are an employee or an associate of Red’s Fresh Fish.

2. Eligibility

All Independent Fishermen must:

  • be 18yrs old or older
  • have a valid Freshwater Commercial Fishing License
  • have a valid Florida Drivers License
  • have your own registered and insured vehicle
  • have at least one cooler with a capacity to hold a minimum of +/- 100lbs (50 Quarts) of whole fish
  • have filet knife and ability to sharpen filet knife
  • have fish skinners
  • have fish scaler
  • have a boat
  • have a motor of some sort to power the boat
    • A gas/hp motor is most common
    • Trolling motor or electric outboard is preferred
  • have paddles
  • have a life vest/jacket
  • have a cast net
  • have a minimum of four (4) trotlines with a minimum hook count of 25 hooks per line (going no less than 25 hooks, use as many as you can handle per line).
  • have a working cell phone
  • be a resident of the state of Florida. [If you live in another state and are interested in this opportunity, submit an application. If possible, we will expand outward to cover your area.]
  • have a PayPal account
  • be available a minimum of one day per week, preferrably a Friday and/or Saturday

3. Your Responsibilities

All Independent Fishermen are responsible for the following:

  • Advertise Red’s Fresh Fish in your local area.
  • Catching a minimum of a coolers full of the requested fish any given week.
  • Supply the fish to Red or an Independent Reseller. Red will let you know weekly who the weekly catch needs to go to.
  • Each year when your Freshwater Commercial Fishing License is renewed, you must submit a copy to Red to continue fishing and selling for Red’s Fresh Fish.
  • All fish from Independent Resellers are to be paid for upfront at the current wholesale price at any given time. If you deliver to an Independent Reseller, you may take your percentage out and must pay Red’s Fresh Fish the percentage due to Red’s Fresh Fish.
    • All orders not reported and all fees due Red’s Fresh Fish not paid will be deemed an “underhanded” and illegal sale. Such activity will terminate your contract and will be reported to the proper authorities.
  • All Red’s Fresh Fish orders are to be submitted to Red as they come in. This includes all direct contact orders you recieve from Red’s Fresh Fish customers and Independent Resellers.
    • All orders not reported and all fees due Red’s Fresh Fish not paid will be deemed an “underhanded” and illegal sale. Such activity will terminate your contract and will be reported to the proper authorities.
  • Depending on the order, you may be required to clean the fish. All fish which are filleted must be filleted salvaging as much meat as possible while at the same time containing no bones in the filet.
  • Agree and abide by all terms stated herein as well as applicable terms stated in Terms For Resellers.
  • Review the website often for updated pricing and any changes to these Terms & Conditions as well as any changes to Terms For Resellers.
    • “Like” our Facebook page. All updates and changes will be posted and/or linked there immediately following said updates and changes.
  • Pay any employees you hire under you.
  • Keep your boat registration valid (yes, FWC requires all vessels, including canoes, that are powered, including trolling motors, to be registered)

You are responsible for all your business expenses, including, but not limited to, Freshwater Commercial Fishing License fees, bait, equipment, and gas.

You are responsible for making sure your business is operating legally within your local area. (This may include you needing to obtain a Business Tax Reciept/Business License under your legal name to operate as an independant contractor.)

4. Red’s Fresh Fish Responsibilities

  • Provide you with all information for any fish needed each week, including that of contact information for any Independent Resellers who need to be stocked.
  • Explain to you and/or show you the proper/preferred way to clean and fillet a fish.
  • Explain to you and/or show you how to properly package the fish.
  • Provide training, if necessary or required, on how to run a trotline from a small vessel (ex: canoe)

5. Prohibited

You are not permitted to do the following:

  • Create your own advertisements or marketing material. Only official Red’s Fresh Fish material may be used.
  • Create a website or blog designed to appear like an official Red’s Fresh Fish site, use Red’s Fresh Fish in the domain or site title, etc. You may advertise Red’s Fresh Fish on an existing blog or site and link to our official site and social media accounts only.
  • Promote our fish alongside nudity, promotions of illegal activities, etc. If you promote us and our fish on any site or social media account that is connected to the promotion of nudity, illegal activities, or otherwise questionable material, you will be terminated from the Independent Fisherman program.
  • Charge a higher price than our listed retail value to consumers. All fish are to be sold at no higher than our listed prices at any given time.
  • Charge a higher or lower price than our stated wholesale value to Independent Resellers. All fish are to be sold to Resellers at no lower than, and no higher than, our wholesale prices at any given time.
  • Re-price stock. You are not to alter prices on packages still in stock if prices go up. The remainder of your stock is to be sold at the listed price on the package.
  • Accept orders for Red’s Fresh Fish “under the table”. All orders for fish must be submitted to Red’s Fresh Fish through our website, email, or phone by the customer or to Red by you before the order is processed. If it’s discovered “under the table” or “on the side” sales are taking place, whether or not the fish is being represented as Red’s Fresh Fish, your contract will be terminated.
  • Compete for Red’s Fresh Fish customers. All fish must be labelled and sold as Red’s Fresh Fish.
  • Market to chains or nationwide retailers. You are not permitted to market or sell to chain stores or nationwide retailers.
  • Accept orders for Red’s Fresh Fish “under the table”. All orders must be submitted to Red’s Fresh Fish through our website, email, or phone by the customer or to Red by you before the order is processed.

Additional Prohibitions For Businesses:

  • Use Red’s Fresh Fish, or any misspelling of our name, in your business name. Use your own, unique business name. You are not to imply your business is in any way connected to, or a subsidiary of, Red’s Fresh Fish. As an Independent Fisherman, you are growing your own business and are contracted to supply fish to Red’s Fresh Fish.
  • Sell fish under your own name to Independent Resellers. All fish sold to Independent Resellers must be labelled as Red’s Fresh Fish.
  • Compete for Red’s Fresh Fish customers. All fish being sold to Red’s Fresh Fish customers (including Independent Resellers) must be labelled as Red’s Fresh Fish. Any and all competition will immediately terminate your contract.
  • Market to chains or nationwide retailers. Under Red’s Fresh Fish label or your own private label, you are not permitted to market or sell to chain stores or nationwide retailers.
  • Accept orders for Red’s Fresh Fish “under the table”. All orders for fish through Red’s Fresh Fish must be submitted to Red’s Fresh Fish through our website, email, or phone by the customer or to Red by you before the order is processed.

6. Permissions

  • You may sell our fish at no higher than our current listed pricing at any given time.
  • You may also apply to be an Independent Reseller.
  • Hire staff: As an independant contractor, this is your right.
    • At your discretion and choosing, you may hire individuals to assist you. These individuals are your employees, and you are therefore responsible for payroll, scheduling, training, etc, to do with these individuals. Red’s Fresh Fish is in no way responsible for your employees you hire beneath you.
    • Any and all employees you hire must keep with the image, terms, etc, of Red’s Fresh Fish

7. Payment

You will be paid a percentage of all sales of any and all fish you supply Red’s Fresh Fish. This percentage will be no less than 10% and no more than 25%. This applies to all fish sold to consumers at retail value as well as all fish sold to Independent Resellers at wholesale value.

  • Commission rate may start at 25% and may raise to no higher than 50% for all Independent Fisherman outside the original market area (Palatka, FL to DeLand, FL).

The percentage will be determined by a number of factors. The percentage may change from time to time, and/or over time. Such factors include, but are not limited to:

  • Your availability
  • Your experience
  • Amount of orders you are able to process
  • Season
  • Size of the catch

Once you are able to process $1,000 worth of orders per week, your percentage may rise. The percentage will raise to no higher than 75%.

Payment will be made either in cash or through PayPal. 

In cases where customers pay in cash, you keep your percentage and submit the remaining to Red’s Fresh Fish.

  • All customers who wish to use PayPal must submit payment directly to Red’s Fresh Fish. You will then recieve your percentage from Red’s Fresh Fish.
  • Payment via Credit/Debit Card is currently only available in the Palatka-DeLand area. 

In occurrences where you are fishing with Red, you will be paid the agreed percentage post-gas reimbursement.

For example: The days catch brings in $400 and cost of gas was $20. You will be paid your percentage of the $380, not $400.

8. Schedule

Within the terms below, you are able to work as little or as many hours a day as you like. You may work anywhere from one day a week to everyday. 

  • Must be available anywhere between the hours of 6am to 9pm. How many hours is up to you, providing all orders for Resellers and Customers are filled as they are received.
  • Must be available any necessary hours required during the week (seven days) prior to a holiday to fill any and all holiday orders by the day before the holiday.
  • Must be available at some point of the working day (see hours above) on Fridays.

9. Termination

Should any of these Terms & Conditions be violated, you’re contract, position, and status as a member of our network, will be immediately terminated. Any funds still owed to you by Red’s Fresh Fish or to Red’s Fresh Fish by you must be paid within seven (7) days of termination.

Upon termination, any and all activity to do with Red’s Fresh Fish must cease. Any and all customers that inquire about new orders are to be directed to RedsFreshFish.com to place their order. Any and all property owned by Red’s Fresh Fish in your possession is to be returned to Red’s Fresh Fish within seven (7) days of termination. 

10. Additional

A. If you are an existing business, please see ‘Terms For Resellers’ on the ‘Terms & Conditions‘ page.

B. All operations for and through Red’s Fresh Fish must keep the Red’s Fresh Fish image of an eco-friendly, mobile fish market.

C. At times, you may be fishing with Red. Any instances fishing is done with Red, and your vehicle is used to get to an area to fish for the day, you will be reimbursed for any gas prior to either party being paid.

D. Members of the Independent Fisherman agreement/program are not permitted to join the Referral Program. To join the Referral Program, you must first terminate your Independent Fisherman agreement.

E. Independent Fishermen may be required to submit a W-9. All Independent Fishermen who submit a W-9 will recieve a 1099-MISC in the beginning of January each year.

F. We reserve the right to deny any application or terminate any agreement for any reason whatsoever.

Acceptance Of Terms

These terms are legally binding. Terms may be updated at any time, with or without notice. It is your responsibility to check often for any updates. If you do not agree to these terms, do not submit an Independent Fisherman Application. Submission of application implies you have read, understand, and agree to all terms stated herein at time of application submission as well as any and all updates and/or changes in the future. If it is discovered any of these terms are being violated, you will be terminated from the program and removed from our network.

Results of becoming an Independent Fisherman is not guaranteed. Your growth and income is entirely dependent upon you. The harder you work and the more time and effort you put in, the more you will earn.

Red’s Fresh Fish is not responsible or liable for lack of income, growth, or your success in any way. Nor are we responsible or liable for any financial loss. 

By submitting an application and being approved, you understand that you are solely responsible for all earnings and/or losses that you may incur due to your being an Independent Fisherman as an Independent Contractor.
